These General Terms and Conditions govern the purchase of products (Product) displayed on this website https://www.luis-figo.com ("Site"), owned by the company Elleeffe srl, located at Via III Settembre 138/B, 47891 Dogana - Republic of San Marino, VAT: SM30124 ("Seller"). Every user ("Customer") intending to make a purchase on the Site must first review this Agreement ("Agreement") before completing the order ("Order"). The submission of an Order implies acceptance. Any changes to the Agreement will become immediately effective upon publication on the Site and will regulate all subsequent Orders.
1. Commercial Conditions
1.1 - The Seller engages in the e-commerce of products available on this Site only for individuals ("Customers").
1.2 - The Customer must provide name, surname, date of birth, email address, product delivery address, tax code, and other personal information. This information must be true, accurate, and consistently updated.
1.3 - The purchase of Products for resale purposes is prohibited.
1.4 - Before electronic submission, the Customer is required to verify the accuracy of the entered data and the purchased products.
1.5 - Following the electronic submission of an Order, the Customer will receive a specific email confirming the purchase and providing the unique identification code associated with the Order.
1.6 - If one or more details in the confirmation email are found to be incorrect, the order will be deemed invalid.
1.7 - The presence of a product on the site does not guarantee its actual availability. It may happen that a product is not in stock due to various issues.

2.7 - In the remote event of an error, negligence, or misconduct related to the transaction management associated with an Order by the payment gateway and payment intermediation systems, neither the Seller nor the Site can be held responsible for such error, negligence, or misconduct.

2.9 - The Seller reserves the right to cancel a transaction and annul the related Order if fraudulent use of the chosen payment method is reported.

3. Shipments and Deliveries
3.1 - The Seller ships and delivers Orders using couriers ("Carriers").
3.2 - The Seller commits to delivering the goods to the Carrier accurately and promptly, respecting the delivery terms indicated on the Site during the purchase phase. However, the Seller cannot be held responsible for delivery delays not attributable to its fault or negligence.
3.3 - In certain circumstances, such as promotions, holidays, or company closures, delivery times may undergo variations. The Seller cannot be held responsible for delays not attributable to its fault or negligence.
3.4 - The Seller will be exempt from liability for delays due to force majeure, strikes, natural disasters, events related to customs clearance, and any other circumstances beyond its control.
3.5 - After delivering the Order to the Carrier, an email will be sent to the Customer within 48 hours, indicating the tracking number with which the Customer can monitor the shipping and delivery process on the courier's website.
3.6 - The Customer is requested to be available to receive the Order.
3.7 - If the Carrier, for reasons other than negligence or issues directly attributable to it, fails to deliver the package, the Customer will be informed of the delivery attempt, and efforts will be made to arrange another Order delivery.
3.8 - In case the courier definitively fails to deliver the Order, the Seller reserves the right to apply an additional charge for storage. In any case, the Customer Service will contact the Customer to confirm interest in a new shipment.
3.9 - At the time of delivery, the Customer must verify the accuracy of the number of packages and the integrity of the external packaging. If anomalies are found in the delivery, such as discrepancies in the number of packages or damages to the external packaging, the Customer must sign the delivery document with reservations and contact Customer Service via email at info@luisfigo.it.
4. Legal Warranty
4.1 - The purchase of products by the Customer is subject to the legal warranty of conformity provided by the Consumer Code, which protects the consumer in the case of defective, malfunctioning, or non-compliant products with the technical specifications on the Site.
4.2 - In the presence of a conformity defect, the Customer has the right to repair or replace the defective product by the Seller, free of charge, unless the requested remedy is impossible or excessively burdensome compared to the other. If replacement or repair is not possible, the Customer is entitled to a full or partial refund of the purchase price.
4.3 - Partial or full refund applies only to the defective product and not to all products in the placed Order. It also never includes shipping costs that the company has incurred for sending the goods.
4.4 - The legal warranty has a duration of two years from the product delivery date and must be asserted by the Customer within 30 days of discovering the defect.
4.5 - The Customer who wishes to avail themselves of the warranty must communicate the defect to the Seller via email at info@luisfigo.it.
5. Right of Withdrawal
5.1 - The Customer has the right to withdraw from the contract with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receiving the products purchased on the Site. However, it is not possible to exchange the chosen item for another.
5.2 - The Seller will proceed with the replacement of the product or refund of the amount paid after it has been returned and verified to meet the following requirements:
A. The return authorization request must be correctly made via pec to the Seller within fifteen (15) days from the delivery date.
B. The products must not have been used, worn, washed, or damaged.
C. The identification tag must still be attached to the products.
D. The returned products must be in their original packaging, complete with any accessories shipped with the products.
E. The returned products must be shipped from the country where the order was placed.
F. The returned products must be delivered to the courier within fifteen (15) days from the date you made your return authorization request.
